Artist Terms & Conditions

1. Definitions:

  • "Us/Our/We" refers to BegsonArts (UK).
  • "You/Yours" refers to the user of our services.
  • "Site/Sites" refers to our website, begsonarts.com, or any other sites that we own and control.
  • "Artwork/Artworks" refers to artwork or craftwork that you own and control for the purpose of selling through our site.
  • "Service" refers to the process of displaying, marketing, and selling your Artwork through our Sites.



2. Acceptance of the Artist:

We have the right to accept or decline your application to market your Artwork through us, and your application indicates your acceptance of our terms and conditions. You must provide accurate and up-to-date information. You agree to have your artwork and descriptive information displayed on our Site. You are responsible for informing us of any changes to your information, pricing, or Artwork status.

 

3. Acceptance of Artworks:

We have the right to accept or decline your application to market any Artwork through us. If a sale is made, you are entering into a legally binding contract with us to complete the sale and dispatch the artwork in the agreed time.

 

4. Non-exclusivity:

You may market your Artwork through other channels simultaneously with marketing through us, provided that it does not affect your ability to deliver the Artwork to the Customer within the specified time and that you do not offer your Artwork at a lower price than what you offer it through us. If the Artwork is sold through another channel, you must immediately remove it from sale on our Site.

 

5. Copyright:

You warrant that all work sold through us is free of any copyright restrictions or intellectual property disputes and that the work is yours to sell. The copyright in the Artwork will remain with you even after ownership of the Artwork is transferred to the Customer. You grant us a perpetual and irrevocable license to use photographs of your Artwork on our Site and in any marketing materials.

 

6. Illustrative Images:

You must supply at least two high-quality digital Images of each Artwork you wish to sell through us: a Gallery Image and a Detail Image. The Gallery Image must show the entire artwork including the frame (if framed) and have a minimum pixel width of 600 pixels. The Detail Image must show a portion of the Artwork to illustrate the grain of the canvas and have a width of at least 600 pixels. The Images must be in JPEG format.

 

7. Pricing and Artwork Details:

You have the responsibility to set the selling price for your artwork, which should include VAT (if applicable), delivery, and our commission. Our commission rate is usually 35% for works sold online and 50% for works displayed in our physical venues. We may agree to offer discounts on your work up to a maximum of 15% using discount codes. You must agree to accept these discounts on the selling price. Once you have accepted the selling price, you must sell the artwork at that price only. Delivery, Packaging, and Insurance We are responsible for the costs of materials, packaging, and delivery to the customer. We will take these costs into account when pricing your artwork. We will ensure that your artwork is safely packaged, labeled, and adequately insured for delivery to the customer. You are not allowed to contact the customer directly or send any information, such as business cards, leaflets, or solicitation letters.

 

8. You must package and arrange delivery of the artwork to us (BegsonArts) within five working days of receiving the order. If you anticipate any delays in delivering the artwork to us (BegsonArts), you must inform us immediately of the reason and expected length of delay. We will attempt to contact the customer, and in some cases, may offer a refund to the customer resulting in the cancellation of the order from you.

 

9. Returns and Damaged Good:

If the artwork arrives to us as damaged, you will be responsible for return postage of the art and the cancellation cost of the order.

 

10. Payment for Artwork:

If your artwork is sold, we will issue a purchase invoice for the agreed selling price. We will pay this invoice no sooner than 28 days after confirming the delivery of the artwork to the customer. Payment will be made by bank transfer.

 

11. Ownership of Customer Relationship:

You acknowledge that the business relationship between the customer and us is entirely owned by us. You must not approach the customer directly or correspond with them in any way, except with our express written authorization. You must not sell directly to the customer or allow a direct relationship to develop between you and the customer that could be detrimental to us. We will not include your contact details in the artwork packaging.

 

12. Disclaimer:

You agree to defend, indemnify, and hold harmless us, our officers, directors, employees, agents, and third parties from any violation of these rules resulting from your use of the service. We provide this service on an "as-is" basis without any warranties, including the implied warranties of merchantability and fitness for a particular purpose.

This Agreement is governed by English law, and any disputes will be resolved by the courts of England. We reserve the right to change the artist's terms and conditions with a minimum of 28 days' notice in an artist newsletter. Your use of the service constitutes your acceptance of these rules.
